Philip Jenkins recently represented the successful claimant in the High Court and the Court of Appeal in a farming proprietary estoppel claim reported at [2019] EWHC 869 (Ch) and [2020] EWCA Civ. 387.
The first instance decision and the decision of the Court of Appeal contain important analysis of the correct approach to ‘remedy’ in proprietary estoppel cases, confirming the primacy and weight to be given to the claimant’s expectation based upon the nature of the assurance made to him, with the essential aim of satisfying the successful claimant’s equity. Philip’s practice encompasses succession and property disputes, both personal and business related, with a particular focus on agricultural matters.
