Simon Taube QC successful in the Supreme Court

Simon Taube QC recently appeared in the Supreme Court on behalf of the successful appellant in Lehtimäki and others v Cooper  UKSC 33. The Court restored the decision at first instance of Vos J, holding that the court had an inherent jurisdiction to order a member of a charitable company, as a fiduciary, to exercise a voting power in a particular way. In the judgment Lady Arden gives a lengthy analysis of the inter-relationship between charity law and company law, explaining why the inherent jurisdiction over charities extends to companies.
