1975 Act Claims: No contest clauses and CFA uplifts
Elizabeth and Philip will discuss the court’s approach to ‘no contest’ clauses designed to dissuade a potential claimant from bringing an application under the 1975 Act and, in anticipation of the forthcoming decision of the Supreme Court in Hirachand, the pros and cons of allowing a claimant’s CFA uplift to be brought into account when assessing reasonable financial provision.
