James discusses the circumstances in which a periodic tenancy implicitly granted might afford protection to a tenant or subtenant of business premises under Part II of the Landlord and Tenant Act 1954, even where there has been a contracted out lease, and how this is affected by the recent Court of Appeal decision in Avondale Park Ltd. v. Miss Delaney’s Nursery Schools Ltd. [2023] EWCA Civ. 641.
