Undue influence update: the JCPC debunks some misconceptions on undue influence , and the Supreme Court adopts a white-line rule on constructive notice
In this webinar, David and Adam will discuss the new white line rule on notice, introduced in Waller-Edwards v One Savings Bank Plc [2025] UKSC 22 the first case in which the Supreme Court has reviewed Royal Bank of Scotland v Etridge [2002] 2 AC 773. They will also discuss Nolan née Jude v Jude [2024] UKPC 22 and Nature Resorts Ltd. v First Citizens Bank Ltd. [2022] 1 WLR 2788, where the Privy Council has cleared away some misconceptions about what is commonly, but inaccurately, called “presumed undue influence”.
