The High Court has ordered the removal of the defendant as personal representative of the estate in an ongoing case of Eboh-Dinsdale v Fowell, which raises important issues concerning a bigamous marriage and competing spousal claims under the Inheritance (Provision for Family and Dependants) Act 1975.
The decision highlights the Court’s role in ensuring that the estates are administered properly during ongoing litigation. Where there are concerns about the administration of an estate, the Court has the power to appoint a new personal representative so that the estate can continue to be managed independently while the dispute is resolved.
