In the latest issue of Trusts & Trustees, Georgia Bedworth and James Kirby discuss the courts’ approach to the application of the open justice principle in trusts and capacity proceedings. The article traces the evolution of the case law and procedural rules both in England and Wales and in offshore jurisdictions. It also takes stock of the position in the Court of Protection following Hinduja v Hinduja [2022] EWCA Civ 1492, in which Georgia and James acted for SP Hinduja’s daughters.
